Types of Information We Collect
The term “Personal Information” includes any individually identifiable information about you, including, but not limited to, your name, email address, picture, voice, user name and password, and any other information that enables us to verify your identity.
We collect Personal Information in two ways. First, we collect Personal Information you give us when you set up an account, like your name and email address. If you want to take full advantages of the services we offer, such as our video and voice chat functions, you can also choose to provide us with your picture, video, and/or voice.
We do not collect information about your usage of the Online Services from your mobile device or browser, including any device identifiers or settings, or information about the location of your mobile device using technologies such as GPS, Wi-Fi, or cell tower proximity.
Why we Collect Information and How It Is Used
The information we collect through your interaction with the Online Services is used to provide our services, develop new features, optimize functionality, personalize users’ experiences, manage users’ accounts, and verify parental consent for the creation of an account for a child under the age of 13. We also use aggregated data that does not personally identify you or your children to improve our existing services and develop new features. Such tracking information includes access times, links that you use, and the content that you viewed.
Your participation in or access to activities is not conditioned on you providing any more information than is reasonably necessary for that activity. Likewise, ustyme does not collect more information from you than is necessary to use its services. ustyme is an online community wherein interacting with others is an inherent feature. Therefore, in order for children to be active, their parents must authorize ustyme to collect Personal Information from their children, including the children’s voice, photos, and videos. ustyme does not record its users’ video or voice chat sessions, and any Personal Information provided for the purpose of engaging in a video or voice chat session is not stored on ustyme’s servers.
Sharing of Information
We will not sell, rent, transfer, or disclose your Personal Information to third parties. However, we may share your Personal Information to the extent reasonably necessary to protect the security or integrity of our Online Services, take precautions against liability, or respond to judicial process or requests from other governmental authorities, or when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual illegal activity. We reserve the right to transfer information we have about you in the event we sell or transfer all or a portion of our business or assets (including in the event of a merger, acquisition, reorganization, dissolution, or liquidation). You will be notified via email or a prominent notice on the Online Services in the event that a change of ownership or control is likely to materially affect the way your Personal Information will be used or handled.
Children under the age of 13 are not allowed to create their own account on ustyme. However, parents of children under the age of 13 may first set up a Senior Account and then may create a Junior Account which is linked to the Senior Account. The Senior Account has complete control over the activities of the Junior Account. If your children are under the age 13, we must have verifiable parental consent before your child is allowed to use the Online Services and before we collect your child’s Personal Information. Such parental consent will be verified by sending an email communication to the email address that is associated with the Senior Account.
Because ustyme is an interactive online community, ustyme must be able to collect Personal Information from children in order for children to use the services offered on the Site and Tablet App. We will not condition a child's participation in any online activity on the child's disclosure of more Personal Information than is reasonably necessary to participate in that activity.
We may collect Personal Information from children as part of an activity. For example:
- We may collect a child's picture, if submitted voluntarily, to associate with the child’s Junior Account;
- We may collect video and/or audio of a child reading a book;
- We may monitor a child’s activity within the Tablet App in order to track achievements.
We use Personal Information submitted by a child solely to enhance that child’s interaction with, and ability to use, the Online Services.
We will not share a child's Personal Information with third parties except to the extent reasonably necessary to protect the security or integrity of our Online Services, take precautions against liability, respond to judicial process or requests from other governmental authorities, when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual illegal activity.
Parents may review the Personal Information we have collected from their child that has not been deleted, and can request that the Personal Information be deleted from our records if it has not been already. Parents also may refuse to permit further collection or use of their child's Personal Information, even if the parent has previously provided consent. To do so, please contact us at the address, telephone number or email address provided below with your request.
Access and Feedback
You are in control of any Personal Information you provide to us through our Online Services. If at any time, you would like to correct the Personal Information we have about you or if you would like to change your preferences for communications from the ustyme team, you can let us know by contacting us at the email or postal address listed below. You can also make adjustments to your Personal Information within the “Settings” feature in the Online Services.
We contact Senior Account holders with notification of promotional materials and any material changes to the Online Services. Senior Account holders will have the option to turn off email notifications from their settings page. If you turn off the email option, you will no longer receive promotional emails. All promotional emails will also contain an ‘unsubscribe’ option in each communication in order for you to opt-out of these promotional emails.
ustyme may from time to time ask you to provide information on your ustyme experiences, which will be used to measure and improve the quality of our services. You are at no time obliged to provide such information. ustyme reserves the right to use anonymized information that does not identify you personally for marketing purposes, for instance, by displaying selected comments without a user's identity on the Online Services, or in communications from the ustyme team.
Links to Other Sites
The Online Services may contain links to other websites for your convenience and information. We are not responsible for the policies or practices of third party websites. If you or your child provide any information to these other sites, different rules regarding the collection and use of that information may apply. We encourage to you learn about the privacy and security practices of other websites if you choose to access and use them.
Data Retention and Security
We will retain your information for as long as your Senior Account and any associated Junior Account(s) are active or as needed to provide you with our services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. It is possible that your information may be retained indefinitely on the ustyme servers.
ustyme has implemented commercially reasonable safeguards to protect the Personal Information, including sensitive data such as credit card information, submitted to us, both during transmission and when we store it. Although we take certain security measures to protect your privacy, please be aware that no security measures are perfect. Please keep in mind that we cannot and do not guarantee that content you post or create using the Online Services (“User Content”) will not be viewed by unauthorized persons and that you post User Content on the Site or Tablet App at your own risk. We are not responsible for the circumvention by you or a third party of any of our privacy settings or security measures. Please understand that, even after removal, copies of User Content may remain viewable in cached and archived pages, or if other users have copied or stored your User Content.
We control and operate ustyme from California. Your usage is governed exclusively by the federal and state substantive laws applicable in California, without respect to conflict of laws principles. Please note that we do not represent or warrant that ustyme is appropriate for use in your particular jurisdiction. Those who choose to access ustyme do so at their own initiative and are responsible for complying with all local laws, rules and regulations.
This Policy is effective as of September 4, 2013. From time to time, it may be necessary for ustyme to change this Policy, and we accordingly reserve the right to modify this Policy at any time. ustyme will notify you by posting any such changes in a revised Policy on the website. Such modifications will become effective on the day they are posted. ustyme encourages you to frequently review the Policy for any modifications. If we make material changes as to how we use Personal Information collected from users, we will notify Senior Account holders by email in order to obtain renewed verifiable parental consent for the new uses of the children's Personal Information.
